RE: The tariff classification of a woman’s blouse from China.

Dear Mr. Gould:

In your letter dated November 28, 2008, on behalf of Michael Stars, Inc., 12955 South Chadron Avenue, Hawthorne, CA 90250-5526, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style S0975, is a woman’s blouse that is constructed from 100% cashmere rib knit fabric with at least 10 stitches per centimeter in both the horizontal and vertical directions. The garment features a V-neckline, long sleeves, a partial front opening with a 4-button right-over- left closure, and lettuce edging finishing the bottom.

The applicable subheading for the blouse will be 6106.90.1010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses and shirts, knitted: of other textile materials: of wool or fine animal hair: women’s. The duty rate will be 13.6% ad valorem.

The blouse falls within textile category 438. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
